I did mention it was being discussed to change it (the level requirement, not the flying ability), it could possibly have been done.

I believe, from what was explained to me, it was less of a flying mount issue and more of an issue with the level the mount was able to be used at compared to the max level cap of the server. This rendered the mount as usuable on the server as a whole.
It is being discussed, however, so this might not be an issue in future marketplace changes.
